In the World Trade Organization (WTO) appeal concerning Colombia’s anti-dumping charges on frozen fries coming from Belgium, Germany, and the Netherlands, arbitrators have found in favor of the EU.
These anti-dumping penalties violate WTO regulations and unjustly restrict access to the Colombian market, according to the final and enforceable judgment.
“The decision is a win for European producers whose exports to Colombia of well over €20 million were affected by the Colombian duties”, stated the European Commission.
The arbitrators affirm that numerous aspects of Colombia’s anti-dumping inquiry, including the dumping margin calculation and the harm analysis, were incorrect. The appropriate authorities have been alerted by EUPPA and its members of the negative effects that such actions would have on the industry. The three EU nations in question export 85% (or EUR19.3m) of the frozen fries to Colombia that are subject to the November 2018 Colombian-imposed levies. EUPPA is relieved that the European Commission and WTO arbitrators heard its request.
“On behalf of the European potato processing companies exporting to Colombia, we sincerely thank the European Commission for its consistent and thorough efforts to ensure that the antidumping investigation is carried out in full compliance with WTO rules. This decision sends a strong signal to the EU’s international trade partners and provides much-needed stability to European exporters in times of uncertainty with major geopolitical and economic disturbances,” Nuria Moreno, EUPPA Secretary General, mentioned.
